What is the difference between a finca and a cortijo?

Finca is the general term for a rural plot with a house. A cortijo is the traditional Andalusian farmhouse, often white, with thick walls, a courtyard and outbuildings. In practice the terms are used interchangeably; we focus above all on the legal status, the land and the condition of the house.

Is the finca legal? What is an AFO?

Many rural homes in Andalusia were once built (partly) without a permit. An AFO (Asimilado Fuera de Ordenación) is the official legalisation declaration issued by the municipality. Before every offer we check the registration, the AFO status and any ongoing proceedings, which is essential for both financing and resale.

Can I extend or renovate on rustic land?

Strict rules apply on suelo rústico: extending or building new is rarely permitted, while renovating within the existing volume usually is. Around Marbella the rules are strictly enforced. We check the zoning plan and the possibilities for each plot before you buy.

What about water and utilities?

Crucial for every finca: is there a mains water connection or a private spring/well with registered water rights? What is the electricity supply like (mains, solar panels, generator)? And the access road? We routinely assess this and have the water rights legally verified.

Can I let my finca near Marbella?

Yes: rural letting works through a VTAR registration (vivienda turística de alojamiento rural) or as a casa rural. Fincas with a pool near Marbella command premium rates from families and groups, with typical gross yields of 4–6%. Before purchase we check whether the finca can be registered.

Can I get a mortgage on a finca?

Yes, but banks are more cautious with rural property: expect a maximum of 50–60% financing and stricter valuations, and a regularised (AFO) finca is practically a requirement. WeSellHomes.es arranges a free mortgage check with English-speaking advisers experienced in fincas.

What are the additional costs of buying a finca?

Fincas are almost always resale properties: you pay 7% transfer tax (ITP), plus notary fees, land registry registration and legal assistance. Allow 10–12% in total on top of the purchase price. Legal due diligence is more extensive for fincas than for apartments, and it is included in our support.
