How does buying a new build in Málaga work?
Buying a new build feels different from buying resale: you often buy something that is still being built. We make every step transparent and guide you entirely in English.
You choose your home and reserve it with €3,000–€10,000. The property comes off the market and the price is fixed.
Within a few weeks you sign the purchase contract and usually pay 20–30% (plus VAT). From this point the statutory bank guarantee applies to your payments.
During construction you pay in instalments according to progress. We monitor the schedule and milestones and report back regularly.
On completion the escritura is signed at the notary, you pay the balance (possibly with a mortgage) and receive the keys. We guide the final inspection.

What are the best neighbourhoods in Málaga for new builds as a foreign buyer?
Málaga has several attractive new-build zones, each with its own character. Teatinos is popular for its university, modern infrastructure and competitive prices. How much VAT and additional costs do I pay on a new build in Málaga?
For a new build in Andalusia you pay 10% IVA (VAT) on the purchase price, not the transfer tax (ITP) that applies to resale properties. On top of that come 1.2% AJD (stamp duty), notary fees and land registry registration. Add it all up and allow 12 to 13% in additional costs. For each development we prepare a concrete overview of the total, so you know exactly what a new-build home in Málaga will really cost you before you decide.
What is the difference between off-plan and turnkey new builds in Málaga?
Off-plan means you buy while the home is still being built, usually on the basis of floor plans and a scale model. You pay in stages: a reservation, then 20–30% during construction and the rest at the key handover. The advantage: the entry price is 10–20% lower than a comparable turnkey home, and you can sometimes still have a say in the finishes. Turnkey is available and ready to move into straight away. We carefully analyse the risks of off-plan, such as delays or financial problems at the developer, before we present a development to you.
Is my deposit protected if the developer goes bankrupt?
Legally speaking: yes, provided it has been arranged correctly. Spanish law requires developers to guarantee buyers' deposits through a bank guarantee or insurance policy. In practice, however, these are not always issued flawlessly. As standard, our English-speaking partner lawyers check that your deposit is fully covered before you sign. This is a step many buyers skip, with potentially serious financial consequences.

Can I rent out my new-build home in Málaga through Airbnb or Booking.com?
Holiday letting is possible but requires an RTA licence (Registro de Turismo de Andalucía). For new builds, this can only be applied for after completion and after the issue of the Licencia de Primera Ocupación. In addition, the owners' community (comunidad) can restrict holiday letting if this is laid down in its statutes. Always check this before buying. We inform you for each development whether letting is feasible, licensable and profitable, including a realistic annual rental yield.
What are the monthly community fees for a new build in Málaga?
In new-build complexes in Málaga, community fees generally range from €80 to €350 per month, depending on facilities such as a swimming pool, lift, security and garden. In the first years the developer sets the amount; after that the owners' community decides the budget. High community fees are not necessarily a disadvantage: they often indicate quality facilities that have a positive effect on rental value and resale price. For each development we give a realistic estimate of all running costs.
How long does it take from purchase to key handover for a new build in Málaga?
For off-plan developments in Málaga, allow an average of 18 to 36 months from signing the contract to the key handover. Delays of 3 to 9 months are the rule rather than the exception in the Spanish building sector, often due to licensing procedures or supply problems. With turnkey new builds you can sometimes move in within 2 to 4 months. Can I get a mortgage for a new build in Málaga as a foreign buyer?
Yes, but the terms differ from a mortgage in your home country. As a non-resident, a Spanish bank will generally finance up to 60 to 70% of the purchase price or valuation. So you contribute at least 30 to 40% of your own funds, plus 12 to 13% in additional costs. Your income, employment contract and credit history are assessed.
