Resale homes: transfer tax
If you buy a home that has been lived in before, you pay Impuesto de Transmisiones Patrimoniales (ITP). The region sets the rate. Andalusia, which covers the whole Costa del Sol, has a flat rate of 7%. In the Comunitat Valenciana, which covers the Costa Blanca, it is 9% up to €1,000,000.
The tax is charged on the price, or on the cadastral reference value if that is higher. You pay it shortly after completion; your lawyer or gestor files the return.
New build: VAT and stamp duty
If you buy directly from the developer, you pay no ITP but VAT (IVA) at 10%, plus stamp duty (Actos Jurídicos Documentados, AJD). Stamp duty is 1.2% in Andalusia and 1.4% in the Comunitat Valenciana.
You pay the VAT with each instalment to the developer. You pay the stamp duty at completion.
Notary, land registry and lawyer
Notary fees are set by law and depend on the deed; allow around 0.2% of the price. Registration at the Registro de la Propiedad costs around 0.1%. An independent lawyer usually charges around 1% plus VAT.
If you buy with a mortgage, the bank has paid most of the mortgage costs since 2019. You pay for the valuation.
Watch out when the seller does not live in Spain
If the seller is not resident in Spain, the buyer withholds 3% of the price and pays it to the Spanish tax office as an advance on the seller’s tax. That money does not go to the seller. Your lawyer arranges it at completion.

What is the transfer tax in Andalusia?

Who pays the plusvalía?
The municipal capital gains tax (plusvalía municipal) is legally the seller’s to pay. Make sure the purchase contract says so explicitly.
Can I include the buying costs in my mortgage?
Usually not. Spanish banks lend part of the price or the valuation, and you pay the costs yourself.
Do I pay transfer tax on a new build?
No. On a first sale by the developer you pay VAT and stamp duty instead of ITP.
